What a Bankruptcy Lawyer Can Do for You | Finance Review

Bankruptcy occurs when an individual has no other options to get out of debt. It is the process that allows people to pay back or at least reduce their debt to credit card companies and banks. The two types of consumer bankruptcy are Chapter 7 and Chapter 13.

Difference Between Chapter 7 And 13

With Chapter 7 one must meet certain criteria before he/she is able to file and is more for people who are unemployed. Chapter 13 is more suited for people who still have a good income, but are struggling to meet their financial responsibilities. In both cases it is imperative to get a bankruptcy lawyer as you must go through the judicial system.

Eliminate Debt Through Bankruptcy

When most people hear bankruptcy they immediately think of it as a negative thing. Others who have filed and been through it may say it saved their lives. The process of bankruptcy is designed to aid the person filing and allow them to get back to living a normal life. Most banks will take a certain percentage out of your paycheck in order to start paying your debt off right away. This way it is not left to spend once the check is cashed. A bankruptcy lawyer is necessary as they are highly trained in this area and will guide you through the whole process.

Keep Your Home with Chapter 13

One of the nice things about Chapter 13 bankruptcy is that both your home and your car will not be repossessed. You will still be able to live in your house but it will be owned by the bank until you pay off its debt. A bankruptcy lawyer will properly represent you in a court of law and give you all the insight you need as to what is next. There is also a chance that a mortgage may be eliminated completely. A good lawyer will ensure you get the best deal that is possible.

Why a Bankruptcy Lawyer is Needed

A lawyer is needed because when you file for bankruptcy you must appear before a court and state your case. The lawyer knows all the ins and outs with this type of thing and will give you a significant edge in being accepted for it. They will tell you how you can put an end to your debt and walk you through the bankruptcy process. People who have questions are more than welcome to call and talk to an attorney to see if bankruptcy is the right move.

Contacting a bankruptcy lawyer will allow you to look at all of your options and create a plan that saves you and your family from the stress of a life full of debt. Visit http://www.BankruptcyLawyer.com for professional lawyers.

How do we know that Challenger Deep is lowest point on Earth?

Using a custom-built submersible, filmmaker James Cameron has successfully visited the Challenger Deep, the deepest point in the world's oceans? How do we know that there isn't somewhere deeper??

James Cameron, the Canadian director of "Titanic", "Aliens" ? and let's not forget, "The Abyss" ? recently emerged from his 35,756-foot dive to the Challenger Deep.

The Challenger Deep is the lowest point in the Mariana Trench, a gap between tectonic plates that stretches 1,500 miles along the western Pacific, and is thought to be the deepest chasm in all the world's oceans. At the bottom the pressure reaches over 15,000 pounds per square inch. By comparison, everyday pressure levels hover around 15 pounds per square inch.

How do we know that Challenger Deep is the deepest point on Earth. Can we be sure that there isn't a deeper spot somewhere?

We can't. Not absolutely. The Challenger Deep was first measured by the HMS Challenger expedition in 1875, a nearly 70,000-mile scientific voyage around the globe that laid the foundations for the modern science of oceanography. To probe the ocean's depths, the Challenger's crew used simple lead weights tethered by long ropes. For this purpose, the vessel carried 144 miles of rope. The first reported depth was 26,850 feet.

In 1951, that figure increased to 35,761 feet when another royal vessel, also named the HMS Challenger, remeasured the depth using a primitive form of sonar: A pulse of sound sent deep to bounce off the abyss, then back topside to the researchers awaiting its return. The official depth would change a few more times after, most recently set on 36,070 feet, a figure confirmed with modern sonar techniques.

This number has a margin of error of about 100 feet,?so it's possible that the measured depth of the Challenger Deep could change in the future, or that some other deeper point will be discovered somewhere else. After all, it was only in 1997 that researchers discovered the?Sirena Deep, which is also located in the Mariana Trench, which they measured at?35,210 feet, less than a thousand feet shallower than the Challenger Deep.

But it's probably unlikely that we'll find a new deepest point in an entirely different part of the world.?Bathymetry, the science of underwater topography, has long been using sophisticated sonar equipment to create digital maps of underwater terrain. Sonar beams sent to the ocean floor are updated many times per second, and verified by Global Positioning Satellites. These maps clearly indicate the Mariana Trench as the deepest of its kind, and so far the Challenger Deep is its lowest measured point. Chances are, if the depth or the location of the world's deepest point ever does change, it won't be by much.

5 ways GOP could finally settle presidential race

WASHINGTON (AP) ? Are we there yet? Not quite. Mitt Romney's two steps forward, one flub back campaign continues its tantalizing progress toward a total victory that always seems just ahead.

Still, the Republican presidential race has got to end sometime, whether it's April or August. Here are five ways to settle this thing:

1. The likeliest route: Romney pulls off a clean win by the time the last state votes in June.

Sure, he's cutting it closer than he'd like, but if Romney keeps up his current pace he can win the necessary majority ? 1,144 delegates ? by June 26, if not sooner. Last-chance Utah, where Romney is embraced by a large population of fellow Mormons, would make a poignant wrap-up.

After Louisiana's primary Saturday, 21 states and the District of Columbia have yet to vote, and Romney's about halfway to the magic number, according to The Associated Press delegate count. If he hits his mathematical mark ? or if his only rival within shouting distance, Rick Santorum, drops out ? Romney instantly becomes the presumptive nominee and the general election race is on.

But Santorum and Newt Gingrich are trying to prevent that tidy Romney finish by sticking in the contest and drawing away votes. That strategy comes as many Republicans are eager to choose a champion and turn the party's attention to defeating President Barack Obama.

___

2. Flying to the rescue: Superdelegates can speed up the finish.

They were empowered just for this sort of scenario. All members of the Republican National Committee automatically attend the nominating convention, and 117 of them are superdelegates whose state party rules leave them free to vote however they choose.

So far most have stayed on the sidelines while the primary plays out. Romney's big win in Illinois and a growing sense of inevitability may draw more superdelegates to endorse him, allowing him to claim the status of presumptive nominee sooner than he otherwise could.

If Romney comes up just shy in the state-by-state voting, superdelegates could push him over the top before the Republican National Convention. They would have plenty of incentive to cut to the finale.

The goal when the GOP meets Aug. 27 in Tampa, Fla., is four scripted days of television that play like a campaign commercial for the nominee, not a reality show full of squabbling factions.

"The Republicans understand the risks of taking this family feud to the convention," said Democrat Donna Brazile, who advised Bill Clinton's presidential campaigns.

Any public bickering would be especially poorly timed this year: The Democrats' meticulously crafted convention, showcasing a president who faced no challengers within his party, comes the week after the Republicans meet.

___

3. A contested convention: Suddenly the long-winded roll call of the states gets interesting.

If Romney fails to snag the necessary delegates, Republicans can buckle up for their most tumultuous convention since Ronald Reagan nearly stole the nomination from President Gerald Ford in 1976.

Ford, lifted to the presidency through Richard Nixon's resignation, had accumulated more delegates than the more conservative, charismatic Reagan. But Ford was short of a majority, leaving the Kansas City convention's outcome in doubt. A rules fight launched and lost by the Reagan forces added to the drama. The tension didn't ease until the roll call vote: Ford eked out the nomination, 1,187 votes to 1,070.

Like Ford, Romney's goal would be to coax more people to his side for that crucial first vote, when most delegates are obligated by state party rules to support the candidate chosen by the voters back home.

If Romney doesn't win that first round, things could get chaotic.

___

4. Winning by losing: Santorum grabs the chance he's been waiting for.

This is the scenario Santorum's campaign is pushing to explain how he could still get the nomination after trailing in primary voting.

If no candidate wins a majority in the first round, GOP rules require roll call after roll call until one person emerges with a majority. After the first round, the delegates are mostly free to back whomever they want, so bargaining can begin in earnest.

Santorum lays out a vision in which Romney is weakened by his failure in the first roll call and the party activists, preferring a more conservative candidate, begin migrating to Santorum.

"The problem with that in the practical sense is it would mean disenfranchising the majority of the Republican voters who voted in the primary process and picked Mitt Romney, to choose someone who got not only less delegates, but far less votes," said Steve Schmidt, who was senior adviser to John McCain's 2008 presidential campaign.

When delegates are unbound, there's no telling which way they'll turn or how long they'll take.

Democrats hold the record: 103 roll calls. That's how many votes it took to dismiss their two leading candidates and dozens of others in 1924 and settle on little-known West Virginia lawyer John Davis. He lost in a landslide to Republican President Calvin Coolidge.

In a more fortuitous choice, Abraham Lincoln came from behind to win the Republican nomination on the third roll call in 1860.

___

5. A brokered convention: The powerbrokers toss out the candidates and draft someone new.

It sounds crazy after decades of hermetically sealed conventions. And it's certainly a long shot. It would mean rejecting everyone who's received actual votes from the Republican faithful. But some delegates might see that as a more appealing way to compromise.

The last time one of the two major parties drafted its nominee ? and the last convention to require more than one roll call ? was when the Democrats turned to Adlai Stevenson in 1952.

The closed conclave of party elders who elevated Warren Harding to the front of the pack at the contentious 1920 Republican convention is believed to be the origin of the term "smoke-filled room."

The likeliest last-minute possibilities this year, such as New Jersey Gov. Chris Christie and Indiana Gov. Mitch Daniels, insist they don't want the call.

Former Florida Gov. Jeb Bush, whose name also has been bandied about, put the kibosh on the idea by announcing his endorsement. He said that "now is the time for Republicans to unite behind Gov. Romney."

South Africa proposes labour law amendments

?Want the latest procurement and supply chain news delivered straight to your inbox??Sign up for the Supply Management Daily

23 March 2012 | Rebecca Ellinor

Pretoria?s cabinet this week approved two bills for submission to parliament that amend the Labour Relations Act (LRA) and the Basic Conditions of Employment Act (BCEA).

The provisions in the BCEA that deal with the prohibition and regulation of child labour are to be extended to cover all work by children, not only work by children as employees. And the maximum prison sentence for an offence involving child or forced labour will be increased from three to six years. The amendments have been proposed to bring the BCEA in line with South Africa's International Labour Organisation Convention obligations.

The other key proposals are designed to tackle temporary labour and prevent exploitation of workers.

Labour minister Mildred Oliphant said the amendments had their origins in the growing ?informalisation? of work that had become a feature of the country?s labour market over the past decade. To stop workers continually being used as casual workers, temporary work will be limited to six months.

?When it comes to the fixed term contract - that should be guided on when that project is going to be finalised. Therefore, those workers will be taken as fixed term contract workers. The workers must be paid equally, irrespective of whether that worker is a temporary worker or a permanent worker,? she said.

Provisions will be introduced to facilitate unionisation of workers, agreements to cover vulnerable workers and ensure the right to permanent employment for affected workers.
The bills will be considered by the Portfolio Committee on Labour before being submitted to the National Assembly and the National Council of Provinces respectively for adoption.

New hope for treating Alzheimer's Disease: A Role for the FKBP52 protein

ScienceDaily (Mar. 20, 2012) ? New research in humans reveals that the so-called FKBP52 protein may prevent the Tau protein from turning pathogenic. This may prove significant for the development of new Alzheimer's drugs and for detecting the disease before the onset of clinical symptoms.

A study published online March 21 in the Journal of Alzheimer's Disease, for the first time demonstrates that the FKBP52 protein, discovered by Prof. Etienne BAULIEU twenty years ago, may prevent hyperphosphorylation of Tau protein, which has been shown to characterise a number of cerebral neurodegenerative diseases, including Alzheimer's Disease (AD).

This work has been carried out by Professor Etienne Baulieu and his research team at Inserm (National Institute for medical research in France) with the support of philanthropists who help the Institut Baulieu, based in France.

Limited research exists on Tau and itsrole in the development of AD, but it is known that many neurodegenerative diseases are characterised by the deposition of pathological hyperphosphorylated forms of Tau protein, into structures known as 'Tau tangles'. The mechanism of Tau toxicity is unclear and there are currently no drug treatments targeting Tau, nor any biomarkers that predict the risk of a future "Tauopathy." Professor Baulieu decided to focus on Tau abnormalities and was the first to discover in 2010, an interaction between Tau, and the FKBP52 protein.*

The new research takes his previous research to the next level. It demonstrates a direct correlation between high levels of hyperphosphorylated Tau protein and reduced levels of FKBP52, in brain cells from patients who have died following Alzheimer's Disease, compared with normal brain cells. This suggests that FKBP52 could control the aberrant production of pathogenic Tau. When FKBP52 is reduced in the nerve cells of AD patients, pathogenic Tau is free to accumulate and contribute to the degeneration of brain cells.

In conclusion, early measurement of FKBP52 levels could form the basis of a predictive test for Alzheimer's Disease before the onset of clinical symptoms, and new compounds modulating FKBP52's activity could become the next generation of treatments for the disease.

Commenting on this new research, Professor Baulieu said: "There is still a worrying lack of research into the causes of age-related brain disorders such as Alzheimer's Disease and dementia. I founded the Institut Baulieu, with the aim of being able to treat and even prevent these diseases.

Research on Tau has been very limited, and until recently, I was among the few scientists focusing on Tau pathology. The discovery of the FKBP52 protein is the only 'anti-Tau' perspective so far. Its reduced production in the brains of Alzheimer's patients marks a turning point in understanding this complex disease.

I believe it takes us one step closer to developing an effective treatment and possible predictive tests for the increasing number of people who may develop Alzheimer's Disease in our ageing societies."

* A role for FKBP52 in Tau protein function. B?atrice Chambraud, Elodie Sardin, Julien Giustiniani, Omar Dounane, Michael Schumacher, Michel Goedert, and Etienne-Emile Baulieu, (2010) Proc Natl Acad Sci U S A., Vol. 107, pp: 2658-2663

Bay Area sees snow, gets dose of cold weather

Bay Area residents were getting a dose of cold and unsettled weather Sunday after a storm system that brought rain and heavy snow in the mountains moved out of the region.

Skies were mostly clear in the Bay Area Sunday afternoon, but forecasters said there was still a chance of showers during the day.

Along the beaches, a high surf advisory is in effect, with a 15- to 17-foot swell expected. The National Weather Service says there's a chance of occasional 20-foot breakers through Sunday.

In the Sierra, a winter advisory remains in place until Sunday evening.

Forecasters say snow showers throughout the day will drop another two to four inches on the more than three feet of snow that fell over the weekend.

Internet Marketing And Advertising Can Benefit Your Small Business ...

Internet Advertising is something which will have a large amount of benefits for both online and real world organizations. Many small business owners decide to market their business and they don?t even know there are plenty of available benefits. When it comes to advertising any type of business you?re going to see that it is a difficult thing to do, as well as the same goes for Internet Marketing. Whether you are doing traditional advertising and marketing or Internet Advertising there?s going to be plenty of work involved. If you have the appropriate knowledge of Internet marketing and advertising, you can use it to build up your business, even if it is offline.

It hasn?t taken a very long time for the Internet to become the form of communication used by most men and women, and it is even becoming the place men and women are doing their shopping. One of the main reasons folks are now doing most of their shopping on the web is because they?re able to get better deals and they don?t need to waste time in a store. This a primary reason that Internet Advertising and marketing is actually a good way to market any kind of business. By now you ought to understand that marketing your offline products on the internet you are going to have the ability to create more revenue. Loads of mom and pop shops are putting their products on the internet, namely Ebay, and they?re finding great success with increasing their revenue utilizing this strategy. Generac 5734 GP15000E review

Traditional marketing methods are considerably more expensive than using Internet advertising, and there aren?t any flyers or brochures needed. Think about precisely how easy it is to utilize the Internet as opposed to using radio or TV marketing, managing a call center or printing brochures. Another thing you need to be thinking about is the vastness of the Internet, you need to bear in mind that when marketing online, the planet is your customer. You might also see that folks will be searching specifically for what ever product you are advertising. I should also point out that you?ll be producing more revenue because men and women are actually searching for your product. Carpal Tunnel Secrets Unleashed

Every single day of the year you are able to be opened, if you have a web based store, and that?s a great advantage. If you don?t see the value yet with advertising on the web just compare the price of marketing online to other real world marketing and advertising costs. Even men and women that are just starting a business have already learned that they?re able to reach millions of men and women if they decide to promote online. As opposed to using phones to contact your potential customers you?ll find that e-mail and instant messaging are the new ways that men and women are keeping in contact. One more thing I should point out is you will have an advantage over your competition when you start to advertise on the net mainly because of your potential customer base.

One final thing that I ought to point out is that with regards to marketing online you will see that there are lots of different methods in which this can be done. You will discover the awareness of your company is going to be increased, and you are able to produce a relationship with your customers. When you realize what Internet advertising can do for your business, it?s there for you to take advantage of. Napoleon AS300K Apollo 3-in-1 Smoker review

Saint Patrick's Day Parades Across the U.S. - Criminal Justice Schools

File:Saint Pats in Chicago- Doing the Splits.jpg

Everybody is Irish this weekend as the country will soon launch into Saint Patrick?s Day festivities, from pubs serving up Celtic tunes and green ales to some municipalities dying their water systems the emerald shade. The United States hosts some of the world?s biggest Saint Patrick?s parades, New York City arguably hosting the largest with over 150,000 marchers participating.

NYC?s law enforcement agencies will not only be patrolling the estimated crowds of two million people ? some sworn personnel will also be marching alongside the profusion of pipers and drummers. In 2010, New York?s Police Commissioner Raymond Kelly was the parade?s Grand Marshall. This year, beginning at 10:45 am he will be accompanying Mayor Bloomberg, followed by the NYPD?s Emerald Society and Holy Name Society marching bands. Other participants include pipes and drums groups affiliated with the New York State Police, New York?s Corrections System, the FDNY, the Coast Guard and the Port Authority Police.

Elsewhere in the state of New York, the Albany Police Department will step up its presence during this weekend?s parade to avoid a repeat of last year?s riot. During the 2011 festivities, a group of college students had surrounded a car smashing all of its windows. ?I can assure you it?s not going to be mayhem again. You?re not going to see a repeat of what we had last year,? said Police Chief Steve Krokoff. He added that due to continuous community involvement and the police department?s Neighborhood Engagement Unit spending 16 hours a day in the college district, the streets in the area are much calmer than the previous year.

According to Savannah Now News, Savannah, Georgia could surpass New York City?s parade size in terms of crowd numbers. The modest estimates 500,000 ? 1 million people (WSAV 3 News and Savannah Now News) makes this prediction seem unlikely, however. Members of the Coast Guard, Marines and Navy, the Irish Pipes and Drums from Dublin and the Milwaukee Police Band are just some of the 15,000 marchers. Local and regional law enforcement agencies have also been preparing for what is expected to be at least a record-breaking surge of crowds for Savannah streets. This past week, an increased number of officers patrolled the area. ?With the police chief, they?ve bent over backward to help us,? said the parade?s Chairman Michael A. Foran. ?It?s a big group effort. They?re bringing police from all over to help?.

Of course Boston cannot be forgotten, due to its large Irish American population and the fact that it hosts the world?s oldest Saint Patrick?s Day Parade. Its annual South Boston event hosts crowds of at least 850,000 people. The Boston Police Department has issued a message to the community outlining certain pertinent laws relating to public drinking, disorderly conduct, disturbing the peace and serving to minors. Its parade takes place on Sunday, March 18th; that day bars are required to close at 7:30pm and liquor stores at 4:00pm.

With issues of safety and security addressed across the nation, families and friends can concentrate on having fun this holiday weekend. Have a safe and happy Saint Patrick?s Day!

Plantiffs Carlos Fernandes, right, Candido Silva Jr. shake hands after the jury ruled that Americo Lopes must pay them, his coworkers, $20 million from his $24 million lottery winnings in Elizabeth, NJ, on Wednesday, March 14, 2012. (AP Photo/The Star-Ledger, Frances Micklow, Pool)

(AP) ? Five construction workers in New Jersey, vindicated by a jury, must wait before learning exactly how much they'll share of a $38.5 million Mega Millions jackpot that a co-worker who was part of their lottery pool claimed as his own in 2009.

A jury in state Superior Court in Elizabeth reached a unanimous verdict on Wednesday that Americo Lopes had cheated the men out of their share of the prize.

The panel rejected the 52-year-old's claims that he had won the jackpot on a personal ticket and not with the ticket that he had bought as part of the lottery pool.

Attorney Rubin Sinins, who represented the five men, said each was awarded $4 million because the jackpot was worth $24 million after Lopes chose the cash option.

However attorney Eric Kahn, who also represented the former colleagues, told The New York Times that details on how much each man would receive and how much each might owe in taxes needed to be worked out.

The men started playing the lottery together in 2007 while they worked for Berto Construction Inc. in Elizabeth.

When Lopes hit the Mega Millions jackpot in November 2009, he told his boss he wouldn't be returning because he needed foot surgery, which he never received. He also filed for unemployment benefits after claiming the $17,433,966 prize after taxes.

His wife, Margarida, testified that her husband finally called one of the men in the group in March 2010 and told him about winning.

"Our clients all feel vindicated" by the verdict, Sinins said. "This has been their position all along; they've been challenged in their position and the jury saw it their way. They are very gratified."

Lopes left court with his wife shortly after the verdict. Speaking in Portuguese, Lopes said he had been robbed, The Star-Ledger of Newark reported.

His attorney, Michael Mezzacca, was disappointed.

"The fact is Mr. Lopes won the lottery by himself with his own money and numbers that he picked," Mezzacca told the newspaper.

When the verdict was announced, the five plaintiffs embraced. They told The Star-Ledger they'll continue to play the lottery as a group, but would copy the ticket.

"I have a lot to do," plaintiff Carlos Fernandez said. "My granddaughter was born yesterday. I have to buy her a present she'll remember."

Debt collection leads Utah complaints

OGDEN -- Residents of the Harrison Regent nursing home who were deluged with fraudulent phone calls about Social Security two weeks ago will probably not be happy that their scam is only the fifth-most popular in Utah last year.

Because the caller claimed to be from the Social Security Administration, the scam ranks below "bank and lender" scams (fourth), but above "Internet services" in popularity last year.

The Utah Department of Consumer Affairs issued two lists of "top 10 consumer complaints" last week as part of National Consumer Protection Week, March 4-10.

One list shows how many times Utahns reported a particular type of scam or fraud to the Federal Trade Commission. The second shows the types of fraud the Utah Department of Consumer Affairs has dealt with in the past year.

Heading the FTC list was debt collection scams, with 1,312 complaints from Utahns who'd been victimized by illegal or fraudulent debt collection attempts.

Second on the list was fake prizes and sweepstakes offers, typically over the Internet but sometimes by telephone.

More than 700 Utahns reported such scams last year. Usually, prize scams involve an email or telephone call telling the recipient that he or she has won some huge foreign lottery. The caller then asks the victim to provide bank account information and some up-front money to pay handling charges and taxes.

The Utah list is similar. Heading the list of frauds the department deals with most are e-commerce and Internet offers, which made up 42 percent of the complaints the division received.

These include situations where a buyer using a computer made a purchase and then had money taken out of a bank account that was not approved, or had some sort of automatic billing set up that they did not approve.

As if to underscore the need for more awareness, a couple of hours after it sent out the list of its Top 10 scams on Monday, the Division of Consumer Affairs sent out another news release warning of a new version of a mobile phone scam.

This one could either be eighth on the list (text and mobile phone services), second (prizes sweepstakes or lotteries) or fifth (imposter scams), depending on how you look at it.

The new warning is for Utahns getting text messages on their cellphones saying the recipient has won a $1,000 Walmart gift card.

To claim the prize they have to go to an Internet website and enter a code word.

The Division of Consumer Affairs checked the site and found that if you enter the code word, the website automatically downloads software to your computer that records every keystroke you make. This lets hackers record bank account information, passwords and other private financial data.

The scam that hit the Harrison Regent was a typical telephone fraud scam.

At least five residents of the home got phone calls, allegedly from the Social Security Administration, warning that the SSA's computers were going to be down for six months and asking for bank information to give them their regular payments directly.

Most of the residents hung up, but one did give the caller her bank information before realizing the call was fraudulent. She immediately notified her bank.

The Division of Consumer Affairs list also includes fraudulent practices that go beyond Internet or cellphone frauds.

They include:

* Coaching services -- typically business opportunities in which buyers invest in training on how to run a business that fails to pay as advertised.

* Retail sales -- including failure to deliver products or failure to honor refunds or warranties.

* Alarm systems -- often sold door-to-door with aggressive sales tactics.

* Home improvement and repair -- usually involving failure to complete the work, substandard work or refusing to finish work until more money is paid.

For more information on consumer fraud or to file a complaint, call the Division of Consumer Affairs at 801-530-6601 or log on to: www.consumerprotection.utah.gov

Apple to add 3,600 jobs at new $304M Texas campus

AUSTIN, Texas (AP) -- Apple Inc. is investing $304 million in a new campus and more than doubling its workforce in the Texas capital, boosted by a $21 million incentive from a state fund designed to attract high-tech companies, Gov. Rick Perry said Friday.

The investment from the Texas Enterprise Fund comes in exchange for a promise that Apple will add more than 3,600 employees at its new facility in Austin over the next decade, including customer support, sales and accounting staff, Perry said.

"Investments like this further Texas' potential to become the nation's next high-tech hub," the governor said in a statement.

Already the world's most valuable company, Apple's market capitalization topped $500 billion this month and remains above that mark - rarefied air that only a few firms, including rival Microsoft and Exxon Mobil Corp, have ever exceeded.

"Our operations in Austin have grown dramatically over the past decade, from less than 1,000 employees in 2004 to more than 3,500 today," said Steve Dowling, a spokesman for the Cupertino, Calif., company.

This week, Apple unveiled its new iPad, featuring a sharper screen and faster processing chip, though the added features mean the tablet computer is slightly thicker and heavier than its predecessor, iPad 2.

The enterprise fund is one of two designed to entice technology companies and top researchers to Texas. Perry said the payout to Apple is one of the largest and the company's job pledge one of the most ambitious since the fund was created in 2003. He said the fund has invested more than $443.4 million and signed contracts to generate 62,000 new jobs and more than $15.4 billion in capital investment.

Tea party activists and other critics of using state money to attract private enterprise call the fund an example of "crony capitalism," complaining that it funnels taxpayer dollars to politically connected firms with little guarantee of job creation. The governor's office says that companies failing to meet job targets can renegotiate the terms of their deals with the state, but must pay penalties known as "claw backs."

A report in November by the political watchdog group Texans for Public Justice found that companies receiving money from the Texas Enterprise Fund created 22,349 jobs by the end of 2010, or roughly 37 percent of the 59,100 jobs that the governor's office said the participating firms had promised to create as of summer 2010.

Perry's office said it only measures the fund's cumulative results - not year by year or contract by contract, since the terms of individual deals change as they are renegotiated. Under that measure, grant recipients promised to create 23,410 jobs by the end of 2010 and exceeded expectations by delivering 33,400.

Google says Brazil?s copyright agency can?t charge bloggers who embed YouTube videos

Yesterday, we reported that the Brazilian royalties collection agency ECAD was arguing that bloggers owed copyright fees for the music videos they embedded, causing uproar.

With YouTube at the center of the controversy, it didn?t take long for?Google to react and declare that ECAD can?t charge such fees.?In a note, which the Brazilian newspaper?O Globo republished in its entirety, Google Brasil?s public policy counsel Marcel Leonardi?expressed the company?s ?surprise and concern? at the agency?s recent move.

As we reported, Google and ECAD have signed an agreement last year with regard to YouTube and music rights. However, according to Leonardi, this agreement ?doesn?t allow or endorse ECAD to charge third parties for embedded YouTube videos?. More precisely, he says, the company took very special care in its negotiations to ensure that users would be able to insert videos on their sites ?without interference or intimidation from ECAD.?

Beyond their agreement, Google also disputes the legal grounding of ECAD?s view that blogs owe copyright fees. As the company points out:

?These sites don?t host or transmit any content when they associate a YouTube video to their site, and as such, the fact of embedding videos from YouTube can?t be treated as a ?retransmission?. As these sites aren?t performing any music, ECAD can?t, within the law, collect any payment from these.?

The following point Google makes is even more interesting; without disputing the legitimacy of ECAD in charging for public music performances on the Internet, the company says that ECAD?s understanding of this concept ?raises serious concerns?and that ?such interpretation can inhibit creativity and limit innovation, in addition to threatening the valuable principle of freedom of expression on the Internet.?

While it doesn?t seem to be considering legal action at this stage, Google now hopes ?that ECAD will put an end to such conduct and withdraw its claims against users who use YouTube videos on their blogs or sites.??As the company reminds, anyone who uploads a video to YouTube can choose not to allow external embedding.

Do you think bloggers should pay music rights for embedding YouTube videos? Let us know in the comments.

Microsoft to shut down Windows Mobile app store

Microsoft will soon shut down the app store for Windows Mobile, the phone platform it is phasing out.

Starting in May, users of Windows Mobile phones won't be able to browse, buy or download apps to their phones from the Marketplace, Microsoft wrote in a letter to customers. The move doesn't affect users of Microsoft's new mobile OS, who will continue to be served by the Windows Phone Marketplace.

Applications already downloaded from the old market will continue to work after May 9, and some publishers might continue to offer their apps through other markets or their own websites, Microsoft said. It cautioned users that if they do a hard reset and delete apps on their phone, they won't be able to download them again from the Marketplace.

The move is a milestone in a transition that has seen Windows Mobile's share of the smartphone market decline from 37 percent in 2006 to 3 percent last year, according to research from NPD Group.

Microsoft's new mobile operating system, Windows Phone, has yet to pick up the slack. It had 3 percent of the smartphone market in October last year, NPD found.

The Blue Planet's new water budget: Do we have enough?

ScienceDaily (Mar. 5, 2012) ? Investigating the history of water on Earth is critical to understanding the planet's climate. One central question is whether Earth has always had the same amount of water on and surrounding it, the same so-called "water budget." Has Earth gained or lost water from comets and meteorites? Has water been lost into space? New research into Earth's primordial oceans conducted by researchers at the Natural History Museum of Denmark at the University of Copenhagen and Stanford University revisits Earth's historical water budget.

The results have just been published in the Proceedings of the National Academy of Sciences.

Water accounts for about ? of a thousandth of Earth's total mass, despite the fact that roughly 70% of the planet's surface is covered by this substance so vital to survival. Indeed, water is a relatively "rare substance" on our "Blue Planet."

Where does water come from?

"One of the absolutely most intriguing things about Earth is that there are oceans of water and that the presence of liquid water has enabled the existence of life on Earth. Therefore, questions concerning how Earth got its oceans, where the water came from and -- whether we are losing or gaining water from space -- are fundamental questions in the understanding of the Earth's history," says Emily Pope of the Nordic Center for Earth Evolution at the Natural History Museum of Denmark, University of Copenhagen.

Earth's "little bit" of water is divided among a variety of reservoirs. Therefore, a fairly accurate assessment of how much water currently exists on Earth can be made. But now, Emily Pope and her colleagues at the Natural History Museum of Denmark and Stanford University have also been able to determine that liquid water was also in existence upon the young Earth, billions of years ago. And, more consequentially, they have been able to approximate the ancient water budget.

The researchers have done this by examining 3.8 billion year old minerals from Greenland which are derived from Earth's primordial oceans.

A "minor" loss

"We have managed to reconstruct the isotopic composition of 3.8 billion-year-old seawater using mineral samples from the Isua-rocks in Greenland. The results demonstrate that the young planet's oceans, in relation to those of today, had proportionately more "normal water" than "heavy water" in them. We can explain this difference by the fact that Earth has lost less than ? of its water budget over the last roughly 4 billion years," says Pope.

It may sound like a lot of liquid, but it's a surprise for researchers that Earth's water budget has been so relatively stable for so many years. The new findings concerning the historical development of oceans also support new theories and suggested solutions to "the faint young Sun paradox." Theories challenging the paradox were propounded by a number of researchers from the Natural History Museum of Denmark and Stanford in 2010.

About the faint early Sun paradox

In 1972, the late, world renowned astronomer and his colleague, George Mullen, formulated "the faint early Sun paradox." The paradox addressed the relative stability of Earth's climate over the 4.5 billion years of its existence in relation to the fact that during the same period, solar radiation has increased by 25-30 percent.

The paradoxical question that arose from the scientists was why Earth's surface, during the planet's infancy, was not covered by ice, when the sun's rays were much weaker than they are today. One possible solution to the paradox, among others, was proposed by the American atmospheric researcher Jim Kasting in 1993. He performed theoretical calculations which showed that 4 billion-years-ago, 30 percent of the Earths atmosphere was composed of CO2. The theory was that the impact of this large amount of greenhouse gas insulated the planet and prevented the oceans from freezing over.

An abundance of atmospheric CO2 however, was not the ice-limiting factor. Instead, a much thinner layer of cloud played a major role in keeping ice at bay. Furthermore, Earth was covered by ocean. This meant that the Sun's relatively unimpeded rays could warm the massive ocean which in turn could store heat and prevent the freezing of its surface, according to the research group from University of Copenhagen and Stanford. This is their current answer to the long-standing riddle.
